Submission and administration of listings/advertisements

Users agree not to submit any property descriptions, photographs, financial details, contact information, or other data related to properties on Townmanor.in unless they have obtained all necessary rights and authorizations from the property owner or the authorized representative, including permissions from the photographer or copyright holder for any images. Townmanor.in does not claim ownership, directly or indirectly, over any content, including banners hosted on its website by customers. These are purely space rentals, and Townmanor.in does not conduct independent verification of the authenticity or legal compliance of these images, banners, or listings as required by law.

Some listings may contain third-party video content ("Video Content") provided solely for general informational purposes. Such content does not constitute a recommendation, solicitation, or an attempt to influence any purchasing decision. Townmanor.in and the video content providers make no guarantees about the accuracy or completeness of this content.

For users subject to RERDA of 2016, it is mandatory to obtain all required approvals, licenses, and permits from the relevant authorities for any project, land, apartment, or plot in their listings, following legal procedures. Users must ensure that they comply with all applicable laws regarding the listed properties. Users are also required to disclose all relevant material information, including details about their RERDA of 2016, registrations, the current status of the property, and whether the property is free of any encumbrances. This includes providing accurate dimensions, property status, and nature of ownership, and users must submit supporting documents when requested by TTPL. Users may be asked to substantiate these claims through an affidavit affirming the authenticity of the information provided.

TTPL reserves the right, at its sole discretion, to search for and remove properties alleged to be submitted in violation of these terms. Additionally, TTPL may request further proof of compliance from users suspected of submitting false property information. TTPL will terminate the accounts of, and deny service to, any user found to have repeatedly or intentionally violated these terms.

By using the service, users grant permission for their property listings or parts thereof to be searched, displayed, accessed, downloaded, copied, or otherwise referred to by visitors to the user's website or Townmanor.in. TTPL retains the right to determine how properties will be displayed, searched, accessed, and used on Townmanor.in, and may modify the listings as needed. Users also agree to the following:

(a) They represent and warrant that all properties and related information provided will be accurate.
(b) They will not post properties on Townmanor.in under a name other than that of the real estate agent duly authorized by the property owner.

TTPL may place property information in specific sections of Townmanor.in or other mirror/parallel sites. TTPL also reserves the right, in accordance with standard commercial practices, to remove any property listings from the user's website or Townmanor.in without prior notice. TTPL is not responsible for verifying the accuracy of reports or data submitted by users. While TTPL will make reasonable efforts to back up data and ensure business continuity, users are solely responsible for maintaining backup copies of all information, photographs, and other materials submitted to Townmanor.in.

Users purchasing or renting properties via Townmanor.in must independently verify all details, including rights, title, ownership, and liens associated with the property. The "verified" tag displayed on some properties merely confirms the existence of the property as advertised, and should not be construed as verification of documents, ownership, area, or pricing detail

Payment Terms

Payments for services provided by Townmanor.in must be made on a 100% advance basis. Once a payment has been made for a subscribed service, it is non-refundable, and the amount will be considered fully appropriated. Any refunds, if applicable, will be at the sole discretion of Townmanor Technologies Private Lmited. TTPL does not guarantee the accuracy or timeliness of refunds reaching the user’s card or bank account. The user acknowledges and agrees that TTPL/Townmanor.in, at its discretion and without limiting its rights and remedies under applicable law, may offset any amount paid by the subscriber/user against any sums owed by the user to TTPL for other products or services under separate agreements or commercial relationships. Townmanor Technologies Private Limited provides no guarantee of server uptime or the proper functioning of applications. Services are provided on a best-effort basis, and liability is limited to the refund of the paid amount. Townmanor Technologies Pvt. Ltd. accepts no liability for free services. Townmanor Technologies Pvt. Ltd. reserves the right to amend, modify, or change any disclaimers or terms of agreements at any time without prior notice. All terms and disclaimers, whether explicitly mentioned or not, are considered included if referenced.

Townmanor Technologies Private Limited takes maximum care to ensure that data related to electronic money transfers is secure and not misused. For online payment transactions, users are directed to a third-party payment gateway, and Townmanor Technologies Pvt. Ltd. does not store or retain credit card information. As transactions occur on external networks not controlled by Townmanor Technologies Pvt. Ltd., once the credit card transaction is completed, the payment details are no longer accessible to anyone at the company, ensuring maximum security.

Townmanor Technologies Pvt. Ltd. is not liable for any loss or damage resulting from the disclosure (inadvertent or otherwise) of account information or details related to online transactions using credit or debit cards. This includes errors, omissions, or inaccuracies in the information disclosed, whether such disclosure occurs during a legal process or otherwise.

 

Refund in failed transactions

Despite the TTPL Payment Reconciliation Team operating 24/7, TTPL does not guarantee the accuracy or timeliness of refunds reaching the subscriber's card or bank account. This is due to the involvement of multiple entities in processing online transactions, limitations of current internet infrastructure, and the working days or holidays of financial institutions. Refunds related to the posting of incorrect or objectionable property content on the site will be at the sole discretion of Townmanor.in.

If you use Townmanor.in in violation of these terms and conditions, TTPL reserves the right to terminate your access, block future access, and pursue any additional legal remedies deemed appropriate.

 

CPL Marketing Campaigns with Developers and Agents/Brokers

1. For CPL (Cost Per Lead) marketing campaigns, TTPL will make every effort to deliver the agreed number of leads at the agreed cost per lead.

2. TTPL reserves the sole discretion to select and utilize the advertising channels or products to generate leads for CPL marketing campaigns.

3. TTPL retains the right, at its sole discretion, to halt any campaign either upon fulfilling its lead delivery obligations or if the agreed payment is not received as stipulated in the terms.

4. TTPL does not guarantee, participate in, or hold responsibility for the conversion of delivered leads or any transactions resulting from them. TTPL acts solely as an intermediary under the provisions of the IT Act 2000. A lead is defined as contact information from a user who has consented to be contacted about TTPL-advertised properties, projects, or similar listings.

5. Any advance or payment received against such invoices is non-refundable.

6. The customer agrees to strictly comply with applicable data privacy laws concerning the leads provided by TTPL.

7. TTPL is not liable for any loss, whether direct or indirect, incurred by anyone for any reason.

8. If the same lead is generated for the same project within 30 days of the initial unique lead generation, TTPL will consider the repeated lead as a duplicate and will not charge for it. In all other cases, the lead will be considered unique.

9.The customer is responsible for safeguarding the personal data contained in all leads in accordance with applicable laws and understands that TTPL's limited consent is only to enable sharing the lead information with the customer.

 

Video Community Guidelines

By submitting video content for listings or advertisements, the user agrees to the following community guidelines:

• The video must be original and free from any copyright issues.

• The video must not include any personally identifiable information of the user or agency.

• The video content must not be obscene or inappropriate.

• The video must not contain language that could be harmful or offensive to any community or group.

 

Video Content Screening

Videos submitted by users will undergo multiple stages of screening, both human and technology-driven, before being made live on the platform. If the video violates the community guidelines, it will be promptly removed from the listing.

Additionally, video screening will occur in the following scenarios:

• If a user reports the video via toll-free numbers or email addresses.

• If an infringement claim is made by an agent or user.

If the claim is validated, the video will be removed from the platform. The platform retains full discretion over the screening and removal of videos.

Agents will have the ability to edit or remove videos during the listing period.

Townmanor.in will use third-party services such as YouTube for hosting and streaming videos. Both the platform and its users must comply with YouTube's Terms of Service (https://www.youtube.com/t/terms) and YouTube API Services – Developer Policies.

Use of Information

Users agree to treat all information obtained from the Service, including listings, the member directory, and any other materials made available through the Service ("Content"), as proprietary to Townmanor.in. Users acknowledge that Content reserved for members is confidential and must be safeguarded as a trade secret of Townmanor.in. The company does not guarantee the accuracy of, endorse, or recommend any Content, and Users engage with such Content at their own risk.

Users may access listings or advertisements on the Service solely for initial information gathering, which may lead to further evaluation and investigation. Access to and use of listings must be limited to personal and internal purposes, and Users are prohibited from distributing, publishing, publicly displaying, or creating derivative works based on the listings or facilitating such actions in any way.

Users are not permitted to use or reproduce any Content obtained from the Service, or made available within the Service, for any other listing or advertising service. Additionally, the Service may not be used in connection with any other listing service or device. Users who violate these terms, particularly by conducting excessive or abusive searches—whether manually or through automated means—may have their membership immediately terminated without prior notice.

 

Intellectual property rights

All logos, brands, trademarks, and service marks ("Marks") displayed on Townmanor.in are the property of TTPL and/or its affiliates, either owned or used under license. All rights related to these Marks, whether statutory or otherwise, are exclusively vested in TTPL and its affiliates. Access to Townmanor.in does not grant the User any license or right to use these Marks in any manner. Any unauthorized use of the Marks is strictly prohibited and will be treated as a violation under the applicable laws of India.

TTPL is committed to respecting the Intellectual Property Rights of all individuals and entities and will continue to comply with all relevant Indian laws in this regard. TTPL also strives to protect the Intellectual Property Rights of users and third parties to the best of its ability. If any User is found using Townmanor.in to infringe upon the Intellectual Property Rights of others, TTPL reserves the right to terminate the User’s access to the platform immediately, without notice.

By granting access to Townmanor.in, TTPL provides Users with a limited, non-exclusive, non-transferable, and revocable license ("License") to access and use the Services, as long as the User complies with the terms and conditions of the Agreement.

 

Restrictions/Prohibitions

The following actions, among others, constitute misuse of Townmanor.in and are strictly prohibited:

a. Misuse of Services: Using the services provided by Townmanor.in in any way that disrupts or negatively impacts the interests and operations of TTPL/Townmanor.in, or in any manner that violates applicable laws and regulations, including the Real Estate (Regulation and Development) Act (RERDA).

b. Unauthorized Use of Content: Copying, extracting, downloading, sharing, modifying, selling, storing, distributing, creating derivative works from, or otherwise exploiting any content, data, or information—such as profiles, personal details, photographs, and graphics—available on Townmanor.in or any services/products of TTPL for purposes not consistent with the Terms of Use. Specifically, users are prohibited from using or exploiting Townmanor.in and its content for:

• Commercial purposes, such as creating alternate databases or granting third-party access to Townmanor.in without TTPL's prior written consent;
• Engaging in any business activity that competes with TTPL;
• Sharing access with individuals who do not have a contract with TTPL;
• Reselling the products/services provided by TTPL.

c. Automated Access: Using or attempting to use automated programs, software, systems, or similar processes (including spiders, robots, crawlers, etc.) to access, navigate, search, copy, monitor, download, scrape, or extract any data or content, including but not limited to adding or downloading profiles, contact details, or sending/redirecting messages from Townmanor.in.

d. Unauthorized Access: Attempting to gain unauthorized access (including but not limited to hacking or password mining) to:

• Any portion or feature of Townmanor.in or any services/products offered through Townmanor.in that are not intended for your use;
• Any servers, websites, programs, or computer systems of TTPL or third parties/other users.

e. Service Modification: Modifying the services provided through Townmanor.in or their appearance using any technology, or overlaying additional offerings on top of such services. Simulating Townmanor.in’s services or functions in any manner without explicit written consent from TTPL (contact us at [email protected]).

f. Accessing Townmanor.in through unauthorized interfaces not explicitly provided by TTPL.

g. Attempting to breach or circumvent any security or authentication measures established by TTPL concerning Townmanor.in, including probing, scanning, or testing system or network vulnerabilities.

h. Scraping, downloading (including bulk downloading), replicating, or extracting any information or data from Townmanor.in (by any means, automatic or manual) to offer products or services similar to or competitive with those of TTPL.

i. Reverse engineering, decompiling, disassembling, deciphering, or attempting any of the aforementioned actions to derive the source code for the Site or Application or any related technology.

j. Circumventing or attempting to circumvent any technological protections employed by TTPL or third parties to safeguard the content on Townmanor.in and to prevent automated systems from crawling or scraping content.

k. Bypassing or attempting to bypass service limits, including but not limited to search limits, Captcha limits, and trigger occurrences.

l. Interfering with or disrupting, or attempting to interfere with or disrupt (using any device, software, or routine), the use of Townmanor.in or any connected computer networks by other users.

m. Developing, using, or attempting to use any automated programs, scripts, robots, third-party software, or similar processes (including spiders, crawlers, browser extensions, iframes on third-party sites, mirroring, HTML parsers, etc.) to access, navigate, search, copy, monitor, download, scrape, or modify any data or content from Townmanor.in without explicit written consent obtained from us at [email protected].

n. Impersonating any individual or entity or falsely representing your employment or affiliation with any person or entity.

o. Forging headers or manipulating identifiers in any way to disguise the origin of user information.

p. Stalking, threatening, or harassing any other user in any manner. q. Imposing an unreasonable or disproportionately large burden on the infrastructure of Townmanor.in. r. • Violates any applicable local, provincial, state, national, or international laws, statutes, ordinances, rules, or regulations.
• Belongs to another person without your right to use it.
• Infringes upon the rights of TTPL or any third party, including copyrights, trademarks, patents, rights of privacy, publicity, or any other proprietary rights.
• Contains computer viruses or other harmful code, files, or programs designed to disrupt, damage, or interfere with the functioning of Townmanor.in or any other computer system or resource.
• Is grossly harmful, harassing, invasive of another's privacy, hateful, disparaging, related to or encouraging money laundering or gambling, or may be perceived as threatening, abusive, or discriminatory based on gender, race, or religion, or otherwise unlawful.
• Constitutes or encourages criminal behavior, creates liability, or violates applicable law.

• Harms minors in any way.
